Michael Brunskill advised a senior commercial property solicitor in a Manchester based law firm.
The police investigation concerned allegations of mortgage fraud. AC was suspected of conspiring with others in order to frustrate the process of a mortgage advance being secured against a commercial property. The failure to properly register the security resulted in the mortgage advance being unsecured and the lender suffering a large financial loss. AC was therefore directly accused of fraud.
During police interview, a detailed defence was advanced on behalf of AC and further representations were subsequently submitted to the police and CPS. This resulted in a CPS decision to halt the investigation and take no further action. AC was therefore released without charge.
